Welcome to HOA THINH PRODUCTION & TRADING JOINT STOCK COMPANY. We are HOA THINH, located at: 11E Street C, Tan Tao Industrial Park, Tan Tao Ward, HCMC, Vietnam, operating an e-commerce business.

When you access our website, it means you agree to these terms. The website reserves the right to change, modify, add, or remove any part of these Terms and Conditions of Use at any time. Changes are effective immediately upon being posted on the website without prior notice. And when you continue to use the website after changes to the Terms and Conditions are posted, it means you accept those changes. Please check regularly to stay updated on our changes.

1. GUIDE TO USING THE WEB

• When accessing our web, users must be at least 18 years old or access under the supervision of a parent or legal guardian.
• We grant a license for you to shop on the web within the framework of the stated Terms and Conditions of Use.

2. CUSTOMER OPINIONS

3. ORDERING AND ORDER CONFIRMATION

• When you place an order at HOA THINH, we will receive the order request and send you an order number. However, the order request needs to go through an order confirmation step. HOA THINH will only confirm the order if your request meets HOA THINH’s order fulfillment criteria.
• For the order request to be confirmed quickly, please provide correct and complete information related to delivery, or the terms and conditions of the promotion (if any) you are participating in.

4. ORDER VALUE AND PAYMENT METHODS

• HOA THINH provides the following payment methods: cash on delivery, International Payment card, or Domestic Payment card.
• Except for some cases with specific notes, you can usually choose one of the 3 payment methods above when placing an order. However, to ensure safety for you during payment, for high-value orders of 30 (thirty) million VND or more, HOA THINH only accepts advance payment by International Payment card or Domestic Payment card.

5. PROMOTIONAL PROGRAMS

• With the desire to bring many benefits to customers, HOA THINH and its member Merchants often have special discount programs. However, to ensure fairness for customers who are the end consumers of HOA THINH, we reserve the right to refuse orders not intended for personal use, bulk purchases, or for resale purposes when you participate in promotions.
• Normally, the maximum quantity of products for each customer participating in a special promotion at HOA THINH is two (02) products. The rules of the promotion will be updated on the promotion page for each program period and may be changed without prior notice to the customer.
• HOA THINH reserves the right to refuse orders that do not satisfy the terms and conditions of participating in promotions without notifying the customer. Therefore, please read the rules of each program carefully before participating.

6. DISCOUNT CODES

• A discount code is a form of discount that HOA THINH offers to customers, which may partially or fully reduce the value of the order.
• Only 1 discount code can be applied per order. You will receive detailed information about the terms and conditions for using the discount code. To ensure fairness for customers who are the end consumers of HOA THINH, we reserve the right to refuse orders not intended for personal use, bulk purchases, or for resale purposes.
• HOA THINH reserves the right to refuse orders using a discount code that does not satisfy the terms and conditions of use without prior notice. The discount code in such cases will not be reissued. Furthermore, HOA THINH reserves the right to refuse the extension of expired codes, codes not used to their full value, or cases where the order is unilaterally canceled by the customer.

7. DELIVERY AREA

• HOA THINH delivers nationwide for products distributed by HOA THINH itself, excluding refrigeration items such as air conditioners, washing machines, refrigerators, freezers, etc., and some other items if the transportation process may affect product quality or customer health.
• For products distributed by member Merchant units, the delivery area may be limited according to the information updated on the product page. In some cases, where the delivery area is not updated in time when you place an order, HOA THINH will contact you to provide details.

8. PRICING

• The product price listed at HOA THINH is the final selling price, inclusive of Value Added Tax (VAT). The price of the product may change depending on the time and accompanying promotions. Shipping fees or Order processing fees will be applied additionally if applicable, and will be clearly displayed on the Checkout page when you proceed to order.
• Although we try our best to ensure that all information and prices displayed are accurate for each product, there will occasionally be errors or inaccuracies. If we discover an error in the price of any product in your order, we will inform you as soon as possible and give you the option to reconfirm the order at the correct price or cancel the order. If we are unable to contact you, the order will be automatically canceled on the system, and a refund will be processed (if the order has been prepaid).
• Price differences: Member Merchants operating on the HOA THINH E-commerce platform may offer the same product with different pricing policies. You have the right to choose and compare prices among member merchants to get the most reasonable price for your order request. HOA THINH does not intervene in the pricing policy of each member Merchant if a dispute arises.

9. PRODUCT INFORMATION

• HOA THINH provides detailed information for each product we post; however, we cannot guarantee to provide information that is completely accurate, whole, current, and error-free for every product.
• In case the product you receive is not as HOA THINH described in the product information section, please inform the Customer Support department as soon as possible after receiving the goods, ensuring the product is in unused condition to be eligible for an exchange or return. 10. POLICY ON COUNTERFEIT, IMITATION, POOR QUALITY GOODS

• HOA THINH aims to provide the best quality goods and services to customers through products sold on our website and refuses to sell illegally manufactured products, copies, counterfeit goods, imitation goods, or goods of unknown origin…
• HOA THINH’s member Merchants are all required to be serious about ensuring the quality and origin of products, and are legally responsible for any violations. For cases where illegally manufactured products, copies, counterfeit goods, imitation goods, or goods of unknown origin are discovered, HOA THINH will immediately suspend or terminate the selling rights and apply sanctions against the violating member Merchant unit.
• In case you suspect a product is illegally manufactured, copied, counterfeit, imitation, or of unknown origin, please notify us immediately by contacting the Customer Support Department at http://www.hoathinh.com.vn/lien-he for information verification and support.

11. TRADEMARKS AND COPYRIGHT

• All intellectual property rights (registered or unregistered), informational content, and all designs, text, graphics, software, photos, videos, music, sounds, software compilations, source code, and underlying software are our property. The entire content of the website is protected by Vietnamese copyright law and international conventions. All rights reserved.

12. LEGAL RIGHTS

• The conditions, terms, and content of this website are governed by Vietnamese law, and the competent Court in Vietnam will resolve any disputes arising from the unauthorized use of this website.

13. PRIVACY POLICY

• Our website takes information security seriously and uses the best measures to protect your information and payment. Your information during the payment process will be encrypted to ensure safety. After you complete the ordering process, you will exit secure mode.
• You must not use any program, tool, or other method to interfere with the system or change the data structure. • Absolutely do not lend your credit card or account to others to make payments at HOA THINH; in case of an unintended transaction, please notify HOA THỊNH so we can provide timely support.

15. TRANSACTION CONCLUSION AT HOA THINH

• Customers shopping at HOA THINH must perform the ordering and receiving steps in the following sequence:

Method 1: Online prepayment via credit card (Visa, Master card..): Step 1: Customer places an order, provides complete and authentic information Step 2: Customer pays in advance; Step 3: HOA THINH checks, confirms the order, and ships the goods; Step 4: Customer checks and receives the goods;

Method 2: Post-payment (Cash on Delivery): Step 1: Customer places an order; provides complete and authentic information Step 2: HOA THINH verifies the order; Step 3: HOA THINH confirms customer information (phone, message, email); Step 4: HOA THINH ships the goods; Step 5: Customer receives the goods and pays;

• In all cases, customers can look up transaction information via the email sent to the customer’s registered mailbox with HOA THINH. Additionally, customers can look up their transaction history by logging into their account on the HOA THINH website.
• If customers want to edit information, they must notify HOA THINH via the HOA THINH hotline or leave a message at http://www.hoathinh.com.vn/lien-he.

16. CHANGING, CANCELING TRANSACTIONS AT THE WEBSITE ADDRESS

• In all cases, customers have the right to terminate the transaction if they have taken the following measures:

17. RESOLUTION OF CONSEQUENCES DUE TO INCORRECT INFORMATION ENTRY AT HOA THINH

• Customers are responsible for providing complete and accurate information when participating in transactions at HOA THINH. In case a customer enters incorrect information sent to the HOA THINH sales website, HOA THINH has the right to refuse to perform the transaction. Furthermore, in all cases, the customer has the right to unilaterally terminate the transaction if they have taken the following measures:

2. Return the received goods that have not been used or from which no benefit has been derived.

18. DISPUTE RESOLUTION

• Any controversy, claim, or dispute arising from or related to transactions at HOA THINH or these Terms and Conditions will be resolved by negotiation, mediation, arbitration, and/or Court in accordance with the Law on Protection of Consumer Rights, Chapter 4, on Dispute Resolution between consumers and organizations/individuals trading goods and services.

19. AGREEMENT TERMINATION PROVISIONS

• In the event of any damage arising from a violation of the website’s Terms of Use, we reserve the right to suspend or permanently lock your account. If you are not satisfied with the website or any terms, conditions, rules, policies, guidelines, or operating practices of HOA THINH, your sole remedy is to stop working with us.

20. OTHER PROVISIONS

All Terms and Conditions (and all obligations arising out of or related to these Terms and Conditions) shall be governed by and construed in accordance with the laws of Vietnam. We reserve the right to amend these Terms and Conditions at any time, and such amendments will be effective immediately upon being posted at HOA THINH.
